QUESTION OF: 1995 Agreement for the Implementation of the Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks

GENERAL ASSEMBLY,

Fully Aware of the 1995 Agreement for the Implementation of the Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks,

Alarmed that regardless of countries’ consent to the 1995 Agreement for the Implementation of the Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks, unreported, unregulated and illegal fishing (UUI) is prevalent,

Keeping in mind nations’ sovereignty over Exclusive Economic Zones (EEZ),

Noting nations’ overexploitation of migratory and straddling fish stocks in the EEZ with deep concern,

Taking into account fishery technology such as Vessel Detection System (VDS), Electronic recording and reporting system (ERS), Vessel Monitoring System (VMS) and etc,Noting with deep concern that the biomass of global fish stocks has been allowed to run down to the point where it is no longer possible to catch the amount of fish that could be caught,Deeply disturbed of the fact that the world’s fishing fleets are running a deficit of US$50 billion each year through depleted stocks and poor fisheries management,

1.       Suggests an universal ratification of 1995 Agreement for the Implementation of the

 Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks;

2.       Requests an establishment of a United Nations-affiliated fishery organization or an international fishery committee such as Regional Fisheries Management Organizations (RFMOs), which:

a) is located in each continent,

b) comprises of representatives from each nation in that particular continent,

c) advises government regarding its fishery policies and standards,

d) cooperates with countries in marine fishery management,

e) undertakes and experiments various fishery research projects with other science institutions,

3.       Asks each nation’s fishermen and vessels to contribute in preserving the marine ecosystem both within and beyond the Exclusive Economic Zones (EEZ) and to the sustainability of fishes by ways such as, but not limited to:

a) reducing by-catch of migratory and straddling fish stocks by methods such as, but not limited to:

i. utilizing selective nets such as trawls,

ii. installing underwater baited hooks,

b) disposing or recycling fishing lines,

c) anchoring boats on mooring buoys,

d) releasing fry when caught,

4.       Further asks United Nations Convention on the Law of Sea to clarify maritime zones mentioned in 1995 Agreement for the Implementation of the Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks such as High Sea and Baselines;

 

5.       Calls upon the United-Nations affiliated organization to identify violations of the 1995 Agreement for the Implementation of the Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks by:

a) Vessel Detection System (VDS)- a satellite-based imaging of sea, which can 1

i. detect fishing vessels,

ii. identify their positions at sea,

b) urging vessels to use:

i. Electronic recording and reporting system (ERS)- a system used to record activities data,

ii. Vessel Monitoring System (VMS)- a satellite-based used in order to provide vessels’ data to the fisheries authorities,

iii. Automatic Identification System (AIS)- a vessel identification system which allows vessels to exchange data with fishery authorities ashore,

c) Positioning land-based inspectors;

6.       Further Calls for fishery conservation programs initiated by governments or other international fishery committees in order to reduce the number of fishery by-catches through means such as, but not limited to:

a) competitions between innovative, efficient and environmentally preservative fishing gears and methods,

b) a new economic trading by-catch credit market between fishermen and fishery organizations,

7.       Urges the UN-affiliated organization or other international fishery committees, with the votes of countries in the region after a given warning, to enforce economic sanctions on convicted nations by means such as, but not limited to:

a) imposing economic embargo on the convicted nation’s seafood exports,

b) encouraging other nations to levy higher tariff on the convicted country’s seafood exports;

c) temporarily expelling guilty nations from future fishery meetings with other countries and organizations mentioned in operative clause 7.

8.       Strongly suggests national governments and the UN-affiliated organization or other international fishery committees to caution the general public by raising awareness of acting in accordance with the 1995 Agreement for the Implementation of the Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks by methods such as, but not limited to:

a) strengthening the fisheries and maritime conservation industry by:

i. establishing fishery institutes and research centers,

ii. investing in more technological fishery equipments,

b) facilitating people’s access to fisheries information by:

i. Advertising in mass media such as television and radio,

ii. Disseminating information on social networking sites and popular search engines,

iii. Providing education in rural and hard-to-reach regions with the help of volunteers,

9.       Recommends all MEDCs to inform the necessary techniques and knowledge of preservation of fish stocks to LEDCs by the way such as:

a) sending the science experts to LEDCs, and design suitable plans of preservation base on different marine conditions in different regions,

b) collaborate with the assistant of local government to maximize the efficiency of the program;

10.   Calls for the Division for Ocean Affairs and Law of the Sea (DOALOS) to develop a new formula for the individual transferable quotas (ITQ) of all member states to fairly initiate restrictions set by the Agreement, based on, but not limited to the following factors:

a) endemic and transient population growth,

b) percentage of industrial production dedicated to fisheries,

c) area of territorial waters and current fish stocks;

11.   Encourages governments, representatives and other fishery-related organizations to convene for an annual conference in which they will discuss accomplishments pertinent to the status of the 1995 Agreement for the Implementation of the Provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks and improvements the world can make to further alleviate the conditions;

12.   Strongly urges all member states and other international fishery organizations to be actively seized on this matter.
